Terms of use

These are the terms between you and wayloop. By using the app you agree to them. They are short on purpose; where they say nothing, Apple's standard licence applies.

1. Who and what

wayloop is an iPhone and Apple Watch app made by Adam Norén, Sweden ("wayloop", "we"). Contact: hello@wayloop.app. These terms cover the app and this website.

2. Your licence

You may use wayloop on Apple devices you own or control, for yourself and not for resale, as the App Store's rules allow. Apple's Licensed Application End User License Agreement applies together with these terms; where the two disagree about something these terms cover, these terms apply. You may not copy, decompile or take apart the app beyond what the law lets you do regardless, or use it to harm the service or other people.

3. Accounts

wayloop works without an account. Signing in with Apple is optional and adds a backup, friends, Leaderboards and Challenges. You must be at least 13. Keep the name you show to others decent; an account used to harass others or to cheat on boards may be closed.

5. Out on the street

A Route is a suggestion drawn from OpenStreetMap data, which can be wrong or out of date. A street on the map may be closed, private, unlit or unsafe. You are responsible for where you go: follow traffic rules and signs, respect private property, keep your eyes on the street and not on the screen, and do not use the app in a way that takes your attention while cycling. Distances, Climb, steps and active energy are estimates. wayloop is not a medical device and gives no medical advice; talk to a doctor before starting hard exercise if you have reason to.

6. What is yours, and what is shared

Your Activities, Coverage, Routes, Places and photos are yours. You give wayloop permission to store and process them only to run the features you use, as the Privacy policy describes. If you add your paint to Everyone's map, the counts it becomes part of stay in the map after you leave, but your own paint is taken out.

7. Map data and names

Map data © OpenStreetMap contributors, available under the Open Database Licence. The app, its design, the name wayloop and the artwork belong to wayloop. Open source licences are listed in the app.

8. Changes and availability

wayloop is made by a small team. Features can change, and the service can be unavailable at times; a City can be added, redrawn or removed, and paint does not always carry over to a redrawn map. If wayloop is ever closed down, subscribers are told beforehand and nothing further is charged. These terms can change; a change that matters is said in the app before it applies, and continuing to use wayloop after that means you accept it.

9. What wayloop answers for

wayloop is provided as it is. As far as the law allows, wayloop is not liable for indirect loss, for loss of data that a backup would have kept, or for what happens out on a Route, and its total liability to you is limited to what you paid for wayloop+ in the twelve months before the claim. Nothing here limits liability for intent or gross negligence, for death or personal injury caused by negligence, or any right you have as a consumer that cannot be signed away.

10. Apple

These terms are between you and wayloop, not Apple. Apple is not responsible for the app or its content, has no duty to maintain or support it, and is not liable for claims about it, beyond refunding the price where a warranty it owes fails. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them. You confirm that you are not in a country under a US embargo and not on a US list of prohibited parties.

11. Law and disputes

Swedish law applies, and Swedish courts decide disputes. If you are a consumer living elsewhere in the EU, you keep the protection of the mandatory law of your country and may sue there. Write first: most things are solved by an email. Consumers in Sweden can also turn to the National Board for Consumer Disputes (ARN).
